Article 2 – GENERAL PROVISIONS
The General Terms and Conditions of Sale (the “General Terms and Conditions of Sale”, or the “GTCS”) are applicable exclusively to the online sale of products offered by the Operator on the Website. The GTCS are made available to customers on the Site where they can be directly consulted and can also be communicated to them upon simple request by any means. The GTCS are enforceable against the customer who acknowledges, by checking a box or clicking on the button provided for this purpose, having had knowledge of them and having accepted them before placing an order. The validation of the order by its confirmation implies adherence by the buyer to the GTCS in force on the day of the order, the conservation and reproduction of which are ensured by the Operator.
Article 3 – PRODUCT DESCRIPTION AND TIMELINES
The Site is an online jewellery sales site (hereinafter the “Product(s)”) open to any natural or legal person using the Site (the “Customer”). The Products presented on the Site are each subject to a description (established by the supplier or accessible on the manufacturer’s site by a link on the Site) mentioning their essential characteristics.
- Made to Measure: All rings are made to order and ship within 30 days (excluding weekends and public holidays). Please refer to individual product descriptions for production timelines.
- Ready-to-Wear: Ready-to-wear engagement rings are processed the next business day.
The photographs illustrating the products do not constitute a contractual document. The instructions for use of the Product, if it is an essential element, appear on the Site or are addressed at the latest upon delivery. The Products comply with the prescriptions of French law in force.
The Customer remains responsible for the terms and consequences of their access to the Site, in particular via the Internet. This access may involve the payment of fees to technical service providers (Internet access providers), which remain their responsibility. Furthermore, the Customer must provide and be entirely responsible for the equipment necessary to connect to the Site. The Customer acknowledges having verified that the computer configuration they use is secure and in working order.
Article 4 – CLIENT ACCOUNT AND GUEST MODE
To place an order on the Site, the Customer may first create a personal client account or place their order as a Guest. Once created, to access it, the Customer must identify themselves using their identifier and their secret, personal, and confidential password. It is the Customer’s responsibility not to communicate their identifiers in accordance with the PERSONAL DATA provisions. Each Customer agrees to maintain strict confidentiality of the data allowing them to access their client space, the Customer acknowledging being solely responsible for access to the Service through their identifier and password, except in the case of proven fraud. The Customer also agrees to inform the Operator without delay in the event of loss or fraudulent use of their identifier. The Customer agrees upon registration to provide real, accurate, and up-to-date information. They also agree not to distribute illegal information (defamation, identity theft) or harmful content (viruses). Otherwise, the Operator may suspend or terminate the Customer’s access to the Site.
Article 5 – ORDERS
The Operator strives to guarantee optimal availability of its Products. If a Product proves to be unavailable after the order, the Operator will inform the Customer by email, and the Customer will have the choice between:
- Delivery of a Product of equivalent quality and price to that initially ordered, or
- Refund of the price of the ordered Product at the latest within fourteen (14) days (legal period) of payment.
It is agreed that apart from the refund of the price, the Operator is not liable for any cancellation compensation. Without prejudice to the right of withdrawal, orders are firm and final. The Customer has the possibility to check the detail of their order and its total price before validating. Confirmation of the order entails acceptance of the GTCS and forms the contract. The Operator strongly advises printing and archiving the order confirmation as well as the digital invoice available in the “my account” space. Any modification of the order by the Customer after confirmation is subject to the agreement of the Operator. While we cannot guarantee modifications once an order has been submitted, we will make every effort to accommodate your request. The Operator reserves the right not to validate the order for any legitimate reason (existing dispute, payment default, etc.).
Article 6 – PAYMENT METHODS AND SECURITY
The Customer expressly acknowledges that any order placed on the Site is an order with an obligation to pay. The Operator uses the PayPlug payment solution. Orders can be paid via:
- Bank card: Secure payment by SSL encryption. Banking details do not pass through the Site.
- Electronic wallet (PayPal): Secure payment without communicating banking details.
- Bank transfer: Banking details will be communicated during the order. Orders are processed within 48 hours maximum following receipt of the transfer.
The impossibility of debiting the sums due will result in the immediate nullity of the sale. As part of control procedures, the Operator may request supporting documents from the Customer.
Article 7 – PRICE AND CUSTOMS (TAX FREE)
Prices are indicated in euros including all taxes (TTC), excluding delivery costs.
- Outside the European Union: Orders shipped outside the EU are exempt from French VAT (20%). Prices do not include customs duties or local taxes of the destination country, which are the exclusive responsibility of the recipient.
- VAT Refund: For eligible clients residing outside the EU, Say Yes in Paris offers a 14% tax refundthrough its partner Planet Payment. Documentation must be requested on the day of purchase.
Article 8 – FORMATION OF THE CONTRACT AND “DOUBLE-CLICK”
The contract is formed when the Customer sends the confirmation of their order using the “double-click” technique: verification of the basket, validation of delivery and acceptance of the GTCS, then confirmation of payment. The “double-click” constitutes an electronic signature and irrevocable acceptance. The archiving of purchase orders and invoices on a reliable medium constitutes a faithful proof of transactions.
Article 9 – RETENTION OF TITLE
The Operator remains the exclusive owner of the Products until full collection of the price and delivery costs.
Article 10 – SHIPPING AND DELIVERY
The risk of loss or damage to the Products is transferred to the Customer when the latter, or a third party designated by them, takes physical possession of the Product (signature upon delivery).
- Packaging: Shipped in discreet protective packaging without outer branding. Jewellery is wrapped in our signature gift packaging.
- Rates: Paris (Free same-day); EU (Free over €2,000, otherwise €100 flat rate); International (Free over €5,000, otherwise €250 flat rate).
Shipments via DHL, FedEx, UPS, or Malca Amit, 100% insured with signature required. Maximum delivery time: 30 days. Upon delivery, the Customer must check the condition of the package and note any reservations on the delivery slip in case of damage.
Article 11 – RIGHT OF WITHDRAWAL, EXCHANGES, AND RETURNS
The Customer has 14 days to return a product.
IMPORTANT – EXCEPTIONS (Art. L.221-28 3° of the Consumer Code): The right of withdrawal, exchange, and refund do not apply to goods made to the consumer’s specifications or clearly personalized (Made to Measure collections, engraved rings, specific resizing, or custom creations).
- Hygiene: Earrings cannot be returned or exchanged.
- Exchanges: Possible within 14 days for non-personalized items (return shipping at customer’s expense). A resizing fee may apply for gold and platinum.
Refunds occur within 14 days of receipt of the product in perfect, unworn condition in its original packaging.

Article 13 – INTELLECTUAL PROPERTY
The Operator is the sole owner of all elements of the Site. Any reproduction is prohibited without prior written authorization.
Article 14 – LIABILITY AND WARRANTY
The Operator cannot be held liable for the non-performance of the contract due to the Customer or force majeure. Products benefit from the legal warranty of conformity (Art. L. 217-3 et seq. of the Consumer Code) and the warranty against hidden defects (Art. 1641 of the Civil Code).
ANNEX 2 – LEGAL WARRANTY SUMMARY
- Deadline: 2 years from delivery.
- Action: Choice between repair or replacement (subject to cost conditions L. 217-12).
- Proof: Exempt from proving the defect during the 24 months following delivery.
Article 15 – COMMERCIAL WARRANTY AND AFTER-SALES
Say Yes in Paris undertakes to repair free of charge any manufacturing defect noted within 12 months following the date of purchase (proof of purchase required). This warranty does not cover normal wear and tear, accidental damage, or interventions by a third party. Claims must be sent to hello@sayyesinparis.com. Refund of return postage costs occurs within 14 days if the defect is confirmed.
Article 16 – PERSONAL DATA AND LINKS
The Operator collects data for order processing in accordance with the GDPR. The Customer has a right of access and rectification. The Operator is not responsible for the content of third-party sites accessible via hypertext links.
Article 17 – MEDIATION
In the event of a dispute, contact hello@sayyesinparis.com. If no solution is found within 2 months, contact the mediator: CM2C, 14 rue Saint Jean, 75017 Paris (www.cm2c.net).
Article 18 – GENERAL PROVISIONS AND APPLICABLE LAW
If any provision of the GTCS is declared null, the others remain in full force. These GTCS are governed by French law. French courts have jurisdiction.
